Clear terms for using Today's Daily Battle responsibly - what you can expect from us, and what we ask from users.
Acceptance
By accessing or using todaysdailybattle.com (the Site), you agree to these Terms of Service. If you do not agree, please do not use the Site.
Use of the Service
The Site provides Scripture search, daily verses, study tools, and community features. Use must remain lawful, respectful, and non-disruptive to other users.
Do not abuse the message board (no harassment, spam, or illegal content). Do not scrape or automate access at scale without permission.
You are responsible for keeping your login credentials secure. Notify us if you suspect unauthorized access.
User Content
If you post messages, prayers, or other content on the Site (including the message board or prayer wall), you:
- Represent that you have the right to share that content and that it does not violate anyone else’s rights.
- Grant Today’s Daily Battle a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content only as needed to operate the Site (for example, showing your message to other users as intended).
- Agree not to post unlawful, abusive, harassing, or deceptive material. We may remove content or restrict access that violates these Terms or threatens the safety of others.
Subscriptions and Payments
Supporter and Church/Team plans are paid subscriptions. When you subscribe:
- You are charged according to the plan you choose (current amounts are listed on Pricing).
- You may cancel anytime; access continues until the end of the current billing period.
- Refunds: If you are not satisfied, contact us within 14 days of a charge. We will work with you and may issue a full refund for the current period when appropriate.
Content and Copyright
Scripture on the Site is from the public domain (e.g. KJV). The Site’s design, text, and tools are © Today’s Daily Battle. You may use the Site for personal and ministry use. You may not resell, redistribute, or frame the Site for commercial use without permission.
Disclaimer
The Site is provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted or error-free service. Scripture tools are for encouragement and study, not legal, medical, mental-health, or licensed counseling advice. Seek qualified professionals when needed.
Limitation of Liability
To the fullest extent permitted by law, Today's Daily Battle and its operator are not liable for indirect, incidental, special, consequential, or punitive damages from use of the Site. Total liability for any claim under these Terms is limited to what you paid in the prior twelve (12) months, or one hundred dollars ($100) if you paid nothing.
Indemnification
You agree to indemnify, defend, and hold harmless Today's Daily Battle and its operator from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party rights.
Governing Law
These Terms are governed by the laws of the State of Tennessee and applicable federal law of the United States, without regard to conflict-of-law rules.
Dispute Resolution; Arbitration
We hope to resolve concerns informally first—email support@todaysdailybattle.com before starting any formal process.
Binding arbitration. If we cannot resolve a dispute informally, you and Today’s Daily Battle agree that disputes will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Rules if those apply), as modified by this section. The arbitration will be conducted in English. The seat of arbitration will be Nashville, Tennessee, unless the AAA rules or applicable law require otherwise.
Individual claims only. You and we agree that disputes must be brought in an individual capacity—not as a plaintiff or class member in any class, consolidated, or representative action. If a court finds this class-action waiver unenforceable in a given dispute, this arbitration clause will not apply to that dispute.
Exceptions. Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.
Opt-out. You may opt out of this arbitration agreement by emailing support@todaysdailybattle.com with the subject line “Arbitration opt-out” within 30 days of first accepting these Terms or within 30 days after a material change to this section is posted (include the name and email associated with your account if any).
Venue (if arbitration does not apply)
If a dispute proceeds in court and is not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Tennessee, except where prohibited by law.
Changes
We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance. The “Updated” date at the bottom of the page reflects the last change. For material changes we will try to notify you via email or a notice on the Site.
